Trump isn't first president to abuse the Constitution, but he's gone so far we need a reckoning

Senator and Governor. Goddard is also co-author of You Won - Now What? Scribner,a political management book hailed by prominent journalists and politicians from both parties. In addition, Goddard's essays on politics and public policy have appeared in dozens of newspapers across the country.

To the point. That pretty much says it all. About Political Wire Taegan Goddard is the founder of Political Wireone of the earliest and most influential political web sites.Throughout his relatively short time as president Donald Trump has verbally assaulted no less than five amendments. The amendment that the president seems to have the most trouble with is the First.

This is quite odd considering he is the type of person that benefits from the right to express oneself. In November ofDonald Trump stated that flag burning should be illegal and that offenders should either lose their citizenship or serve jail time.

In this statement Trump showed a disregard for not only the First Amendment but most likely the Eighth and Fourteenth Amendments as well. Johnson that flag burning was protected speech under the First Amendment. The decision in Afroyim v. Rusk found that it was unconstitutional to involuntarily strip a person of their citizenship as it is a violation of the Citizenship Clause of the Fourteenth Amendment.

With Troy v. In one tweet Donald Trump showed his urge to violate three amendments. In a later tweet, the president stated that the NFL should lose its tax breaks because it allows its players to kneel during the national anthem. According to constitutional scholar Eugene Volokh, this type of retaliation would violate the First Amendment.

The President seems to struggle with the concept of freedom of the press as well, as he has tweeted that he would like to take away press credentials for organizations that give him negative coverage. These tweets show a pattern of complete disregard for our constitutional amendments.

He has gone so far as to pardon authorities that violated the Constitutional rights of U.

Sheriff Joe Arpaio was found guilty of violating the Fourth Amendment through racial profiling and unlawful searches and seizures. The president should uphold the Constitution and seek to remove those that violate it, not pardon them or reward them. Recent amendments to come under fire by the president are the Second and Fifth Amendments. This is an especially interesting thing to hear from a Republican president, considering the importance Republicans place on the Second Amendment, it further proves the total disregard this president has for the Constitution.

This is a very shortsighted way of thinking. It also sets a dangerous precedent and trend. Trump supporters have shown some alarming views when it comes to the First Amendment. He has also criminally obstructed a Department of Justice investigation of himself but escaped prosecution because of the intercession of an attorney general more loyal to him than to the U.

At the outset of his presidency, Mr. Trump took the presidential oath of office promising that he would faithfully execute his obligation to preserve, protect and defend the Constitution.

Earlier this week, Mr. The Constitution was written in Philadelphia during the summer of The framers — the 55 state delegates to the Constitutional Convention who authored the Constitution — had just completed fighting the Revolutionary War, which had ended six years earlier.

While Americans universally revere the American Revolution today, that was not the case at the time it was fought. Professor Bernard Bailyn of Harvard, whose 75 years of professional study of the colonial mindset is without peer, has argued that in the s about one-third of the colonists supported the revolution, while around the same number favored staying in the British empire, and about the same number were indifferent.

Byaccording to Mr. Bailyn, there were substantial groups of wealthy persons in America who retained their loyalty to the British king, and there were government officials here who had originally obtained their jobs by royal appointment. Bailyn has documented fatal violence occurring on American soil between Americans loyal to the king and Americans loyal to the principles of the Declaration of Independence, after the British surrender in and even after the signing of the Treaty of Paris in All of this was known to the framers, who feared the resurgence of British influence in the American government.

Their fears centered around the corruption induced by titles of nobility — which in those days were often accompanied by lands and income — and gifts of money or real estate. In order to allay those fears and assure Americans that officials in the new federal government would be immune from foreign seduction, the framers included the Emoluments Clause in the Constitution. The Constitution is known for phrases of generality and elasticity, the meanings of which are often capable of reinterpretation by modern standards.

This is not so for the Emoluments Clause. It originally presented and continues to present an absolute prohibition of the receipt of anything of value by a federal government officeholder from a foreign government. By that interpretation, Mr. Mulvaney announced, Mr. Trump was able to offer a resort in South F orida owned substantially by a family corporation he controls as the host of his next meeting of G-7 — a group that includes heads of government from six foreign countries — so long as the resort did not earn a profit from the gathering.

After a weekend of torrential criticism, Mr. Trump announced that he had changed his mind and said he would not host the G-7 meeting at the Miami area resort. Who knows what he meant by phony?

The clause is in the Constitution and it means what it says. Yet, whatever Mr. Trump meant by phony, it constituted at least a disparagement of the Constitution he has sworn to uphold and at worst a threat to ignore clauses he can disparage. This is most unusual and potentially dangerous, and it raises the question: Can the president lawfully enforce only the clauses of the Constitution with which he agrees and ignore those with which he disagrees?

In a word: No. The doctrine of the separation of powers — which is the backbone of the Constitution — states that Congress writes the laws, the president enforces them and the courts interpret them. It also offers that the governmental roles of the three branches cannot be intermingled or traded without doing violence to the personal liberties that the separation was intended to secure.

If the president could pick and choose which laws to enforce and which parts of the Constitution to ignore, he effectively would be deciding what the laws mean — a judicial function — and which laws have vitality and which do not — a congressional function. It may be true that Donald Trump has read the Constitution.

I will gladly lend you my copy. Khan, who has never met me, has no right to stand in front of millions of people and claim I have never read the Constitution, which is false. It may be the case that Trump has read the Constitution. But to go by his public positions, it remains a question whether he understands it.

From early in his campaign, critics have been consistently astonished by his seeming indifference to the Constitution, as he has launched attacks on the press, on mosques, and on other institutions explicitly protected by the Bill of Rights. A lot of people understand it. Some really bad things are happening. This is known as the Free Exercise Clause. Even this modified proposal, however, would run afoul of not only the Free Exercise Clause but also the Free Speech Clause of the First Amendment, which allows us to stop speech that incites immediate violence but not broadly controversial speech that might inspire some future violent act.

In a constitutional democracy, it is essential that the press has broad freedom to investigate public officials so that voters have the information needed to hold them accountable.

You have to fight fire with fire. The Eighth Amendment prevents the use of cruel and unusual punishment, protecting people within the U.

If this is indeed their purpose, and if he means to apply them to the war on terror within the United States, then they are clearly unconstitutional. In fact, they would serve well as hypotheticals that constitutional law professors might use to demonstrate how the ban on cruel and unusual punishment might be violated.

But the 14th Amendment is key here. The policy would, in effect, deny the right of Muslims who are U. Trump has attempted to walk the statement back, claiming that while his ban focused on only those seeking to immigrate to the U. The high court has held that immigration restrictions based on ideology do not necessarily violate the Free Speech Clause, but discrimination based on religion is different.

However, they also suggest a fundamental misunderstanding about the role of the judicial branch in U. The judicial branch is not supposed to be beholden to personal interests of the president.

In fact, the founders designed the judiciary to counter the power of the presidency. Currently, we have many checks to protect an independent judiciary. Many build on trends that have been apparent for years and practices engaged in by prior administrations. But they have presented themselves in particularly extreme or virulent forms during the past four years.

Exactly years after the Constitution was signed, on Sept. Some of these constitutional failures stem from provisions in the document itself, such as the concentration of military and administrative authority in the person of the president.

In such cases, the expansion of presidential power might be expected under the so-called "unitary executive" theory. But these otherwise innocuous design features present unique dangers when the political system has resulted in the selection of an authoritarian-minded president, or when other constitutional actors fail to produce the counteracting checks intended to hold presidential power in place and assure its responsible use.

The result is that some constitutional provisions have been violated and others have been inexplicably ignored or treated as inconsequential. A few examples prove the point. New laws should bar emergency declarations from lasting more than a fixed number of days without congressional approval, and authorize either house of Congress to challenge any such declarations or executive orders in court.

Further, no president should have power to reprogram funds where Congress has already considered the issue and rejected the funding, such as Trump did by using Defense Department authorizations to partially build his border wall. The law should require presidents to disclose their tax returns. Except to repel a military attack, the power to engage in a war should return to Congress as the founders intended. Ellis Cose: We're trapped in an obscene distortion of democracy.

But we don't have to be. InFriedrich von Hayek wrote an influential book, "The Road to Serfdom," mapping the tendencies of national socialism to erode democracy and individual freedom. Unchecked and imbalanced government represents another road to serfdom: the tendencies toward the tyrannical concentration of power in a single leader. The road back to the rule of law consists of restoring the original understanding of the Constitution. No guard rails: Delay the election?

Take Trump seriously. Laws and the Constitution haven't stopped him yet. And when the executive branch exceeds its constitutional authority, Congress shirks its constitutional duty, or the courts fail to enforce constitutional commands, these institutions place our republican democracy at risk.

Regardless of who wins in November, shoring up these norms serves as the surest safeguard of republican constitutionalism and the rule of law.

The Hollywood Reporter spoke with the head writer of the eerily dead-on episode, "Bart to The Future," recently to find out exactly how he arrived at such a once-unthinkable scenario.

In the episode, Lisa Simpson is president and at one point says, "As you know, we've inherited quite a budget crunch from President Trump. It was pitched because it was consistent with the vision of America going insane.

But while The Simpsons may have predicted the future, Scandal presented its fictionalized Trump in an episode set in the now, with Hollis Doyle (Gregg Henry) returning last Thursday as a Trump-like candidate who felt all too close to the real thing.
